The following terms and conditions apply to all orders via our online shop.


§ 1 basic provisions

1.1 The following terms and conditions apply to all contracts that you conclude with us as a provider via the website www.Ballclaw-shop.eu. Unless otherwise agreed, the inclusion of any conditions you may have used is contradicted.

1.2. A consumer in the sense of the following regulations is any natural person who concludes a legal transaction for purposes that can largely not be attributed to their commercial or independent professional activity. 2.3. By placing the products in the online shop, we make a non-binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded by clicking on the order button to accept the offer for the goods contained in the shopping cart. Immediately after submitting the order, you will receive another confirmation by email.

2.4. The processing of the order and the transmission of all information required in connection with the conclusion of the contract is partially automated via email. You must therefore ensure that the e-mail address you have stored with us is correct, the receipt of the e-mails is technically ensured and, in particular, is not prevented by SPAM filters.


§ 3. Contract language, contract text storage

3.1. The language available for the conclusion of the contract is German.

3.2. We do not save the complete text of the contract. Before sending the order via the online shopping cart system, the contract data can be printed out or electronically saved using the print function of the browser. After we have received the order, the order data, the information required by law for distance contracts and the general terms and conditions will be sent to you again by email.


§ 4. Delivery conditions

4.1. The delivery conditions, the delivery date and any existing delivery restrictions can be found under a correspondingly labeled button on our website or in the respective item description.

4.2. Insofar as you are a consumer, it is legally regulated that the risk of accidental loss and accidental deterioration of the sold item only passes to you when the goods are handed over, regardless of whether the shipment is insured or uninsured. This does not apply if you have independently commissioned a transport company not named by the entrepreneur or someone else to carry out the shipment.


§ 5. Prices and payment modalities

5.1. The prices listed in the respective offers as well as the shipping costs represent total prices. They include all price components including all applicable taxes.

5.2. The shipping costs are not included in the purchase price. They can be called up via a correspondingly labeled button on our website or in the respective article description, are shown separately in the course of the ordering process and are to be borne by you, unless free delivery is promised.

5.4. Unless otherwise stated for the individual payment methods, the payment claims from the concluded contract are due for payment immediately.

5.5. The following payment methods are generally available in our shop:

    Prepayment: If you choose the payment method prepayment, we will give you our bank details in a separate email and deliver the goods after receipt of payment.
    Cash on delivery: You pay the purchase price directly to the deliverer. There are plus 4 euros as costs.


   PayPal:

In the ordering process, you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must be registered there or register first, legitimize with your access data and confirm the payment instruction to us. After placing the order in the shop, we ask PayPal to initiate the payment transaction. You'll get more information during the ordering process.

The payment transaction is carried out automatically by PayPal immediately afterwards.

    PayPal Plus:

As part of the PayPal Plus payment service, we offer various payment methods as PayPal services. You will be redirected to the website of the online provider PayPal. There you can enter your payment details, confirm the use of your data by PayPal and the payment instruction to PayPal. You will receive further information during the ordering process.

If you have chosen PayPal as the payment method, you must be registered there in order to pay the invoice amount, or you must first register and authenticate with your access data. The payment transaction is carried out automatically by PayPal immediately after confirmation of the payment order.

If you have chosen the credit card payment method, you do not have to be registered with PayPal to be able to pay the invoice amount. The payment transaction will be carried out immediately after confirmation of the payment order and after your legitimation as a legitimate card holder by your credit card company at the request of PayPal and your card will be charged.

If you have chosen the direct debit payment method, you do not have to be registered with PayPal to be able to pay the invoice amount. With confirmation of the payment instruction, you give PayPal a direct debit mandate. You will be informed by PayPal about the date of the account debit (so-called prenotification). Upon submission of the direct debit mandate, PayPal immediately asks its bank to initiate the payment transaction. The payment transaction is carried out and your account is debited.

If you have selected the payment method invoice, you do not have to be registered with PayPal to be able to pay the invoice amount. After a successful address and credit check and submission of the order, we assign our claim to PayPal. In this case, you can only pay to PayPal with a debt-free effect. § 6. Retention of title, right of retention

6.1. The goods remain our property until full payment.

8.1. If goods are delivered with obvious transport damage, please report such errors to the deliverer as soon as possible and please contact us immediately. However, they help us to be able to assert our own claims against the carrier or the transport insurance.


§ 9. Warranties and guarantees

9.2. The limitation period for claims for defects is one year from delivery of the goods.
9.3. The above restrictions and shortened deadlines do not apply to claims due to damage caused by us, our legal representatives or vicarious agents

    in the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the contractual partner can regularly rely (cardinal obligations)
